Anand Karaj Marriage Registration पर Supreme Court का बड़ा फैसला

सुप्रीम कोर्ट ने 4 सितंबर 2025 को दिया गया अपना ऐतिहासिक निर्णय में स्पष्ट कर दिया कि अब
Anand Karaj विवाह पंजीकरण पूरे भारत में अनिवार्य होगा। यह फैसला न केवल सिख समुदाय के लिए
महत्वपूर्ण है बल्कि भारत की संपूर्ण विवाह पंजीकरण व्यवस्था और नागरिक अधिकारों के लिए एक
मील का पत्थर साबित हुआ है।

इस निर्णय का मूल आधार Anand Marriage Act, 1909 की धारा 6 है, जिसमें राज्यों पर यह कानूनी
कर्तव्य डाला गया था कि वे विवाह पंजीकरण के लिए नियम बनाएँ और एक समान प्रणाली लागू करें।
कई राज्यों द्वारा नियम न बनाए जाने को सुप्रीम कोर्ट ने असंवैधानिक माना।

राज्यों और केंद्र सरकार को जारी किए गए आदेश

सुप्रीम कोर्ट ने भारत के 17 राज्यों और 7 केंद्र शासित प्रदेशों को कड़े निर्देश दिए कि वे
चार महीनों के भीतर Anand Marriage Act की धारा 6 के तहत नियम बनाकर गजट में प्रकाशित करें।
साथ ही, उन्हें इन नियमों को विधान सभा के समक्ष प्रस्तुत करना भी अनिवार्य होगा।

जब तक नए नियम लागू नहीं हो जाते, तब तक भी Anand Karaj विवाहों का पंजीकरण समान रूप से
किया जाएगा, और विवाह प्रमाणपत्र में स्पष्ट रूप से उल्लेख होगा कि विवाह Anand Karaj
विधि के आधार पर संपन्न हुआ है।

Section 6(5): दोबारा पंजीकरण की कोई आवश्यकता नहीं

अदालती आदेश में यह भी कहा गया कि एक बार Anand Marriage Act के तहत विवाह पंजीकृत हो जाए,
तो किसी भी अन्य कानून के तहत दोबारा पंजीकरण की आवश्यकता नहीं है। कई राज्यों के अधिकारी
गलती से यह मांग करते थे, जिसे सुप्रीम कोर्ट ने गलत बताया।

Nodal Officer की नियुक्ति और मॉडल नियम

हर राज्य को दो महीनों के भीतर एक सचिव-स्तर का Nodal Officer नियुक्त करने का निर्देश दिया

केंद्र सरकार को भी दो महीनों में Model Rules तैयार कर राज्यों को भेजने और छह महीनों में

विशेष राज्य: गोवा और सिक्किम

कुछ राज्यों जैसे गोवा और सिक्किम में संवैधानिक प्रावधानों के कारण प्रक्रिया थोड़ी
अलग है। गोवा में Union of India को पहले विशेष अधिसूचना जारी करनी होगी, उसके बाद राज्य
नियम बना सकेगा। वहीं सिक्किम में Article 371F के कारण कोर्ट ने अलग निर्देश दिए।

अधिकारियों द्वारा मना करने पर नागरिकों की सुरक्षा

सुप्रीम कोर्ट ने स्पष्ट किया कि कोई भी अधिकारी केवल इस आधार पर Anand Karaj विवाह के
पंजीकरण से मना नहीं कर सकता कि “नियम नोटिफाई नहीं हुए हैं”। यदि मना किया जाता है, तो
अधिकारी को लिखित कारण देना होगा और वह आदेश चुनौती योग्य होगा।
